The new deportation attempt comes after Abrego Garcia declined a plea deal that would have sent him to Costa Rica if he pleaded guilty to human smuggling charges.
Earlier this month, the 30-year-old Salvadoran immigrant was released from a Tennessee jail where he had been detained since June after he was brought back to the US from El Salvador.
The Trump administration has long attempted to portray Abrego Garcia as a violent gang member, and ICE alleged that he was a member of MS-13 due to his Chicago Bulls attire and the accusation of an informant.
