“The outcome of your criminal charges really can be affected by who your defense attorney is. If a defense attorney comes in to meet with a prosecutor and the DA is rude, condescending, or even just generally a pain in the ass, the prosecutor is not going to offer as good a plea deal, and will be more willing to take a case to trial over giving the defendant a break. And if a defendant does NOT have counsel, the worst thing they can do when they meet with the prosecutor is to try to act like they know the law better. Don’t try to use legal terminology, and definitely do NOT try to talk down to the prosecutor. Never have I ever thought, Wow, that defendant really knows the law. I guess I should drop these charges against him because he’s not going to let me pull any shenanigans.”
“Usually, they end up with a worse deal than they would have if they had just come in and been polite and respectful, and depending on the situation, willing to be accountable. Oh, and one more thing: ‘Jailhouse lawyers — aka that guy in your holding cell who knows all about the law and is going to give you free legal advice? Don’t listen to him. They are wrong basically all the time, but when you say something in court, the judge and prosecutor can usually tell which jailhouse lawyer you got your bad info from. Bottom line: Don’t take advice about how to get out of jail from someone who is also IN JAIL, because clearly they suck at it.”
